1) Ordering
(a) Proof Approval: By approving the proof (sent via external communication) for the product, you acknowledge and agree that you have verified that spelling and content in the product proof are correct; you are satisfied with the document layout in the product proof; understand that the Custom Plus will produce the product in accordance with its appearance on the product proof (subject to the limitations specified herein); and cannot make any changes to the order once the order is placed, irrespective of whether you have actually reviewed the product proof or not. You assume all responsibility for any typographical errors or any other errors found in the products that are also in the product proof. You acknowledge and agree that Custom Plus is not responsible for any errors in the products found on the product proof which you did not inform Custom Plus. Custom Plus will in no event be required to provide any refunds of the fees you paid for such order for any unreasonable cause whatsoever.
(b) Colour Shift: You acknowledge and agree that Custom Plus will not be responsible for any color shift that occurs in conversions from RGB to CMYK. Custom Plus is not responsible for the degradation in quality of the images printed, including fuzziness, distortion, pixilation, or any other type of degradation from the provided artwork, designs, and images when such degradation is caused by the nature of artwork you provided to Custom Plus. Custom Plus will ensure all efforts to match the colours in the product proofs to the products.
(c) Order Approval: You are responsible for reviewing each order and the product proof provided to you prior to making an order. Custom Plus will not accept changes to orders you have approved and placed. In the event you accidentally made an incorrect order, including, without limitation, sending the wrong file, you may still have to bear the cost of the initial order as Custom Plus may have already processed the order and began production. In the event Custom Plus already started production of the products, Custom Plus has the right to reject any re-submissions. Where you fail to review the product proof and ask Custom Plus to print the products without review or approval of the product proof, you will do so your own risk, and Custom Plus will not be responsible for any errors, problems, or other issues with the products where the product proof has not been reviewed. Custom Plus has no responsibility to re-print any order if flaws, errors, or problems are found in the product proof after initial production.
(d) Order Cancellation: An order cannot be canceled or modified once it has gone into production, and Custom Plus is not responsible for any refunds once the order has gone into production.
(e) Reprints: A reprint will only be honoured if a printing or trimming error occurs. Printing or trimming errors are inspected during the Quality Assurance Inspection. A shift of design (by 5%) during trimming will not be reprinted. Custom Plus will notify you if a reprint is necessary. (f) Rush Orders: Rush orders are the only way to guarantee a completion date, otherwise all order completion dates are estimates, which depends on how large the print queue is. If a deadline is required then it will need to be specified before an order is placed. A rush fee may be applicable to your order to guarantee the deadline. Rush fees can only be added to orders before they go into production.
2) Delivery, Shipping, and Pick Up
(a) Delivery: Custom Plus will notify you once your order is completed and ready for delivery. Custom Plus will then discuss a date and time that suits in both favours. Your order will be delivered by Custom Plus to the address provided. Your order will be delivered to the exact address provided by you. Custom Plus is not responsible for stolen packages once dropped off.
(b) Shipping: Custom Plus is not responsible for stolen or lost packages on the shipping couriers' behalf. Shipping fees are applicable. Shipping couriers' terms are available upon request.
(c) Pick-Up: Custom Plus will notify you once your order is completed and ready for delivery. Custom Plus will then discuss a date and time that suits in both favours. Pick-up address will be provided upon completion.
3) Pricing
All prices listed on the website or any and all external media platforms monitored by Custom Plus are in currency of CAD unless otherwise stated, and are subject to change by Custom Plus without any direct notice to you.
4) Your Content
(a) You are solely responsible for ensuring all provided images and artworks will not infringe on any patent, copyright, or trademark. You agree that you will not include any text, image, design, trade-mark, service mark, or any copyrighted work of any third party in any of your order, unless you have obtained the appropriate authorizations from the third party owners. By placing an order, you represent and warrant that you have all necessary permission/right to place the order and you authorize Custom Plus to produce the products on your behalf. Custom Plus will not be held liable for infringement of this term by anyone.
(b) Custom Plus offers a "free-of-charge" designing service* if and only if the order is placed with Custom Plus. In the case,
(1) you would like to keep the design and not go through with a print with Custom Plus, you will be subjected to a fee of $35.00+ (CAD) for each design;
(2) you are not satisfied with the final product and want to take the aforementioned "free-of-charge" design to another company, you will be subjected to a flat fee of $35.00 (CAD) for the design.
*creation of logo, website, and other design are not included as they vary in prices.
(c) File transfers are not free of charge unless the order of the file is placed with Custom Plus. Future transfers have a flat fee of $10.00 (CAD).
(d) By placing an order with Custom Plus, you are bestowing Custom Plus the right to display all work Custom Plus has printed or created as part of Custom Plus's portfolio (unless you have asked for work to not be displayed).
